The courts have figured out how to confirm the experience if the cost of the certifying state contract is not enough

12 August 2020, Wednesday

A bidder with additional requirements complained that the winner was incorrectly determined. He claimed that the winner did not submit the documents necessary to confirm the experience.

Among other things, it was necessary to send a completed contract (contract) worth at least 20% of the NMC.

The Supervisory authority and the courts did not support the participant. In particular, they indicated that the winner submitted a contract whose value was less than the established limit. However, in addition to the application, it sent the following documents:

- minutes of the meeting of the technical Council, which agreed on additional work under the submitted contract for the missing amount, as well as estimates for them;
- determination of the court, which confirmed that all the work was performed.
Based on the court's ruling, payment orders for these works were also submitted later in the proceedings.

Thus, the experience is confirmed. The winner was determined correctly.
