It is proposed to expand the range of persons whose information is subject to inclusion in the RNP under Law No. 44-FZ

A draft federal law has been submitted to the State Duma for consideration, according to which Article 104 of Law No. 44-FZ is proposed to be supplemented with a new Part 2.1, providing for the inclusion in the RNP of information on procurement participants who became winners, as well as on contractors who executed contracts, as a result of providing false information about work experience related to the subject of the contract as part of applications. It is assumed that customers will send an appeal for the inclusion of information about these persons in the RNP within 10 days from the date of identification of the fact that false information was provided as part of the applications.

Recall that according to ch. Article 2, Article 104 of Law No. 44-FZ currently includes information in the RNP:

- on procurement participants who evaded the conclusion of contracts;

- about contractors who have not fulfilled or improperly fulfilled obligations stipulated in contracts.

At the same time, as follows from Part 7 of Article 104 of Law No. 44-FZ, contractors who have not fulfilled or improperly fulfilled obligations under contracts include:

- the counterparty, from the execution of the contract with which the customer unilaterally refused on the basis of part 9 of Article 95 of Law No. 44-FZ and in some cases on the basis of paragraph 1 of Part 15 of Article 95 of Law No. 44-FZ;

- the counterparty with whom the contract was terminated by a court decision due to a significant violation of the terms of the contract by the counterparty;

- a counterparty who unreasonably unilaterally refused to execute the contract.
