We apply anti-dumping measures when purchasing VED

Specialists of the Ministry of Economic Development of the Russian Federation explained that the procurement participant with whom the contract is signed isn't obliged to observe anti-dumping measures if during purchase execution on VED supply the price of the contract for 25% offered them and more below NMTsK, but at the same time the price on each line item included in lot above extremely registered prices.

Let's remind that by the general rule anti-dumping measures are applied in the cases provided h p.1 and the 2nd Art. 37 of the Law N 44-FL namely if when carrying out tender or an auction by the procurement participant with which the contract, contract suggested price, which for 25% and more below NMTsK is signed. However for purchases of VED of the p. 12 of Art. 37 of the Law N 44-FL the exception is established. According to this regulation of a provision of Art. 37 of the Law N 44-FL aren't applied in case of implementation of purchases of VED if the procurement participant with whom the contract, the suggested price of all purchased medicines reduced no more than on 25% concerning their selling price registered according to the legislation on marginal drug circulation is signed.
