The customer on 223-FZ can limit participation in the purchases of legal persons violators

The Ministry of Economic Development considers: the customer has the right to demand in documentation that concerning the participant there were no judgments which have come into force. It is about decisions on application of sanctions for violation of contractual obligations.
To include such requirement in documentation, we advise an opportunity to establish it to enshrine in the provision on purchase. The provision on purchase under the Law N 223-FZ is the main document which regulates purchasing activity of the customer.

The winner presented to the customer a signed draft contract and an independent guarantee to ensure its execution. He paid a commission for receiving it. Since the inspectors found violations in the purchase, the protocol of summing up and the procedure for concluding the contract were canceled.

The Ministry of Finance spoke about the procedure for paying for the results of the execution of the contract, taking into account the conditions for the "deduction" of the penalty from the amount owed to the counterparty

The letter prepared by specialists of the Ministry of Finance of the Russian Federation emphasizes that if the contract includes the condition provided for in paragraph 2 of part 14 of Article 34 of Law No. 44-FL, if the counterparty violates the terms of the contract, the customer is obliged to apply appropriate liability measures, including withholding the amount of unfulfilled claims for payment of penalties (fines, penalties) from the amount to be paid payment to the counterparty.
