The government approved the rules by which procurement plans will be drawn up under the Law N 44-FZ

The order by which customers will plan purchases for 2020 and subsequent years has been published. It is developed taking into account amendments to the Law N 44-FZ which entered into force on October 1, 2019. Under the new rules, customers will make a schedule for a longer period and specify less information in its form.

For whom are the rules developed

The new order concerns all customers according to the Law N 44-FZ (item 2 of the Order). Regions and municipalities will not be able to Supplement their rules and requirements to the form of the schedule.

How will make plans-schedules for a longer period

According to the amendments to the Law N 44-FZ and the new order, the schedule will need to be drawn up for the duration of the law or the municipal act on the budget (paragraph 4 of the Order). For example, Federal customers will have to make a schedule for three years.

In the Order specified: the approved schedule will have to be amended every year, taking into account the new adopted act on the budget. It will be required to correct data on the next financial year, the first year of the planning period and to Supplement the document with information on the new year of the planning period (item 6 of the Order).

How much time will be allocated for the formation and approval of the schedule

As under the old rules, customers have 10 working days to approve the schedule after receiving the limits of budget obligations or approval of the FHD plan (paragraph 12 of the Order). Plans-schedules will form in the process of drawing up and consideration of draft laws on budgets or when planning financial and economic activities (item 8 of the Order).

What information about the purchase will need to be specified in the schedule

Under the new rules, the schedule will need to make much less information than under Regulations N 553 and N 554. The schedule will contain:

information about the customer, in particular: name, TIN, location (p. 14 of the Order). This information will be generated automatically in accordance with the information included in the register of participants of the budget process;

the identification code of procurement;

OKPD2 code;

name of the object of purchase;

planned year of purchase start;

amount of financial security (planned payments) for the corresponding financial year;

information about the availability of public discussion.;

name of the customer-organizer for centralized or joint procurement.

Customers no longer have to:

detail information about the object of purchase-include its description, the quantity of goods and the amount of work, services, unit of measurement;

provide information about the NMCC and the price of the contract with the sole supplier, the amount of the advance, the CTP, the stages of payment;

report other information about the procurement, for example: the method of procurement, the amount of security of the application and the execution of the contract, the advantages, prohibitions and conditions of admission, the possibility of procurement only among SMEs and SONKO.

When to make changes to the schedule

Besides the bases provided by amendments to the Law N 44-FZ, the schedule will change in cases when it is necessary, in particular:

clarify information about the object of purchase;

comply with the instructions of the control bodies;

recognize the purchase failed;

terminate the contract.

When will the new rules work

The new procedure should be applied in the preparation of procurement schedules for 2020. Certain provisions on the interaction of the EIS and the "Electronic budget" system in the formation of schedules for a number of customers will work in 2020.
