The Ministry of Finance told how to combine admission conditions with benefits for organizations with disabilities
The Ministry of Finance explained how to provide preferences to organizations with disabilities in the procurement of imported goods with admission conditions.
Based on the results of the electronic auction, the customer enters into a contract with the winner, an organization of disabled people, who offered a foreign–made product, at the same time taking into account:
• advantages under Article 29 of Law No. 44-FZ;
• Admission rules by order 126n.
The preferences from Article 29 of Law No. 44-FZ and Order No. 126n are mutually exclusive. To calculate the value of the contract, the customer must reduce and increase the price offered by the bidder.
Thus, in an auction with admission conditions and benefits for the disabled, apply the following rule. If the organization of the disabled, which offered to supply foreign goods from Appendix No. 1 to order No. 126n, won, then conclude the contract at the price offered by the participant in the purchase. If the purchased product is included in Appendix No. 2 to Order No. 126n, then reduce the contract price offered by the participant by 5 percent.
