Data on qualification of the participant aren't attached to the protocol of consideration and an assessment of applications

The position of the Ministry of Economic Development is based that the Law N 44-FL doesn't establish a duty of the customer to attach information on their qualification to the protocol of consideration and an assessment of applications of participants of a competition.

We consider, this conclusion is connected with the following. It is provided in the Law N 44-FL that together with the protocol the proposal of the participant of an open competition is submitted, and when purchasing goods - also data on its price and the name of the country of origin. The offer has to contain information on the evaluation criteria established in documentation and object of purchase.

It is proposed to expand the range of persons whose information is subject to inclusion in the RNP under Law No. 44-FZ

A draft federal law has been submitted to the State Duma for consideration, according to which Article 104 of Law No. 44-FZ is proposed to be supplemented with a new Part 2.1, providing for the inclusion in the RNP of information on procurement participants who became winners, as well as on contractors who executed contracts, as a result of providing false information about work experience related to the subject of the contract as part of applications. It is assumed that customers will send an appeal for the inclusion of information about these persons in the RNP within 10 days from the date of identification of the fact that false information was provided as part of the applications.
