The state customer has the right to limit remoteness of the place of rendering services in documentation

The Ministry of Economic Development, repeating this conclusion, warns against creation of conditions which lead to restriction of the competition among procurement participants.
According to the Ministry of Economic Development, the state customer has the right to define in documentation how far there has to be a place of rendering services. It is possible to express distance in kilometers or to specify borders of the administrative district, territorial education.
Expressed similar opinion of the Ministry of Economic Development, for example, in October, 2016.
We believe, explanations of the ministry will be useful in cases when services are rendered in the territory of the performer. Purchases on servicing of cars and performing pretrip medical examinations of drivers are an example.

The cassation considered it superfluous to require documents on payment of the contract to assess the experience under Law No. 223-FL

According to the terms of the purchase, the participants had to provide, among other things, a document on the payment of the contract, which was declared to assess the experience. According to the customer, the requirement was established, in particular, to reduce the risks of improper fulfillment of obligations by the counterparty.

It is proposed to expand the range of persons whose information is subject to inclusion in the RNP under Law No. 44-FZ

A draft federal law has been submitted to the State Duma for consideration, according to which Article 104 of Law No. 44-FZ is proposed to be supplemented with a new Part 2.1, providing for the inclusion in the RNP of information on procurement participants who became winners, as well as on contractors who executed contracts, as a result of providing false information about work experience related to the subject of the contract as part of applications. It is assumed that customers will send an appeal for the inclusion of information about these persons in the RNP within 10 days from the date of identification of the fact that false information was provided as part of the applications.

The list of authorized organizations with which it is possible to conclude contracts without conducting a competitive procedure has been supplemented

The President of the Russian Federation signed a Federal law providing for the expansion of the list of organizations specified in paragraph 6 of Part 1 of Article 93 of Law No. 44-FL, with which contracts can be concluded without conducting competitive procedures.
