The state customer can include in the contract a condition that the advance payment is the commercial credit

As considers the Ministry of Economic Development, definition in the contract of such condition doesn't contradict the Law N 44-FZ and the Civil Code of the Russian Federation. Department has come to this conclusion, having considered the following situation: the condition about the commercial credit is included in the contract concluded following the results of an electronic auction.
We believe, recommendations of the ministry are applicable also to the procurements conducted by different ways. Therefore, a condition that the advance payment is the commercial credit it is possible to include in any contract concluded on 44-FZ.

A draft federal law has been submitted to the State Duma for consideration, according to which Article 104 of Law No. 44-FZ is proposed to be supplemented with a new Part 2.1, providing for the inclusion in the RNP of information on procurement participants who became winners, as well as on contractors who executed contracts, as a result of providing false information about work experience related to the subject of the contract as part of applications. It is assumed that customers will send an appeal for the inclusion of information about these persons in the RNP within 10 days from the date of identification of the fact that false information was provided as part of the applications.
