The Finance Ministry explained what to do when the state customer is not supplied with the medicaments that is specified in the contract

According to the Law № 44-FZ, another medicaments can be taken from the supplier if its characteristics are improved. The institution considers that the state customer can independently decide which of medicaments have advantage.

It is important to remember: the rules for the purchase of vitally important and essential medicaments are stricter. It is forbidden to replace the medicament of a particular manufacturer or country of origin, which is specified in the application, if the delivery is carried out in compliance with government restrictions.

In 2014, the Ministry of Finance already indicated that the customer determines the criteria for improved performance by itself. Then the conclusion concerned any goods, works and services.

A draft federal law has been submitted to the State Duma for consideration, according to which Article 104 of Law No. 44-FZ is proposed to be supplemented with a new Part 2.1, providing for the inclusion in the RNP of information on procurement participants who became winners, as well as on contractors who executed contracts, as a result of providing false information about work experience related to the subject of the contract as part of applications. It is assumed that customers will send an appeal for the inclusion of information about these persons in the RNP within 10 days from the date of identification of the fact that false information was provided as part of the applications.
